Welcome to StoryScapes NYC Gallery & Tours (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). By using our Services, you agree to these Terms. If you do not agree, you may not use our Services.
1. Use of Services
- You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services.
- You agree to provide accurate information when making purchases or contacting us.
- You may not use our Services for unlawful, fraudulent, or harmful purposes.
2. Products and Orders
Art Prints & Merchandise
- We sell photography prints and related products fulfilled through third-party providers such as Printful. All items are subject to availability.
Walking Tours
- Tours are designed for small groups (up to 10 guests). By booking, you agree to follow the guide’s instructions and comply with local regulations. We reserve the right to deny participation to any guest who behaves in a disruptive or unsafe manner.
- Availability is limited to specific times, typically late afternoons, evenings, and select weekends or holidays. Scheduling is arranged with us after purchase, and we cannot guarantee availability outside these windows. We recommend booking early to secure your preferred time
Order Acceptance
- We reserve the right to refuse or cancel any order if fraud or misuse is suspected.
3. Pricing & Payment
- All prices are listed in U.S. dollars unless otherwise stated.
- We use Shopify’s secure payment system. By submitting your payment, you authorize us (and our payment processors) to charge the applicable amount.
- You are responsible for any taxes, duties, or fees that apply to your purchase.
4. Cancellations & Refunds
- Art Prints & Merchandise: Because items are made to order, sales are generally final. Please contact us if an item arrives damaged or defective.
- Walking Tours: Tours may be canceled for a full refund with at least 72 hours’ notice. We reserve the right to cancel tours due to weather, safety, or unforeseen circumstances, in which case a full refund will be issued.
5. Intellectual Property
- All photos, images, text, and other content on this website are owned by StoryScapes NYC or licensed to us.
- You may not copy, distribute, or use our content without prior written consent.
6. Limitation of Liability
- Our Services are provided “as is” without warranties of any kind.
- To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages.
- For walking tours: participation is at your own risk. We are not responsible for injuries, property loss, or other issues that may occur during the tour.
7. Third-Party Services
Our store is powered by Shopify, and some products are fulfilled by third parties (e.g., Printful, shipping carriers). Their terms and policies apply to your use of their services.
8. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
9. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted here with an updated “Last updated” date. Continued use of our Services means you accept the updated Terms.
